The Mobility Lease: Flexibility and Benefits for All

The ELAN (Evolution du Logement, de l’Aménagement et du Numérique) law enacted in November 2018 introduced a new form of rental contract: the mobility lease.

What is a mobility lease?

The mobility lease is a rental contract for furnished accommodation, lasting from 1 to 10 months. This type of lease has been designed to meet the housing needs of the following people:

  • In vocational training
  • In higher education
  • Apprenticeship contracts
  • On placement
  • Doing civic service
  • On professional transfer
  • On temporary assignment

The benefits of a mobility lease

Flexible duration
Unlike conventional leases, mobility leases are not automatically renewed. However, it may be adjusted once, provided that the total duration does not exceed 10 months. Once the defined period has elapsed, the contract automatically terminates, obliging the tenant to leave the property, unless a classic rental lease is signed with the owner. The owner is free to enter into several successive mobility leases with different tenants without any limitations.

Simplified regulations
The mobility lease is not classified as a tourist seasonal rental. As a result, the owner does not need to file a declaration with the town hall or obtain any specific authorization. Rent can be set freely by the owner, except in zones where rents are regulated.

Warranty
The owner may require a deposit (different from the security deposit). A guarantor is a person who undertakes to pay rental debts in the event of non-payment by the tenant. What’s more, landlords can benefit from the Visale guarantee, a free scheme that covers unpaid rent and damage to property, facilitating access to housing for young people and mobile professionals. It is up to the tenant to request this guarantee and provide it to the landlord.

Flexibility and efficiency

The disadvantages of a mobility lease

No security deposit
The owner cannot ask for a security deposit. In the event of unpaid rent or damage, you must rely on the security deposit or the Visale guarantee.

Limits of the Visale guarantee
For damage, the Visale guarantee covers an amount equivalent to a maximum of two months’ rent (including charges), whereas the guarantee for unpaid rent covers the entire term of the lease.
